Terms of Service

These Terms of Service ("Terms") govern your access to and use of openasin.com and our services (collectively, the "Service"), operated by Anna Bauman, doing business as OpenASIN ("OpenASIN," "we," "us," or "our"), based in Pennsylvania, United States.

By creating an account, making a purchase, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. DESCRIPTION OF THE SERVICE

OpenASIN provides AI-generated competitive intelligence reports based on publicly available customer reviews of Amazon-listed products. You submit an Amazon Standard Identification Number (ASIN), and we analyze the publicly visible reviews for that product to provide insights including common complaints, common compliments, missing features customers want, and suggested improvements.

2. NO AFFILIATION WITH AMAZON

OpenASIN is NOT affiliated with, endorsed by, sponsored by, or otherwise officially connected to Amazon.com, Inc. or any of its subsidiaries. "Amazon," the Amazon logo, the smile design, and "ASIN" are trademarks of Amazon.com, Inc. or its affiliates. Our use of the term "ASIN" is descriptive and refers to the publicly available product identifier system Amazon uses. Our use of the term "Amazon" is nominative and used solely to describe the platform from which review data is sourced.

We do not access Amazon seller accounts, private seller data, or any non-public information. All analysis is conducted on customer review content that is publicly visible to any internet user visiting Amazon.com.

3. USER ACCOUNTS

To use the Service, you must create an account by providing a valid email address. You agree to provide accurate information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

You must be at least 18 years old to create an account. By creating an account, you represent that you meet this age requirement.

We reserve the right to suspend or terminate accounts that we reasonably believe are being used for fraudulent activity, abuse of the Service, or in violation of these Terms.

4. PAYMENT AND BILLING

The Service offers the following paid plans:

Single Report: a one-time charge of $19 USD for one competitive intelligence report on one ASIN.

Pro Plan: a recurring monthly charge of $47 USD for unlimited competitive intelligence reports.

All payments are processed by Stripe, Inc. By making a purchase, you authorize us and Stripe to charge your payment method for the applicable amount.

Pro Plan subscriptions automatically renew every month at the same price until you cancel. You can cancel at any time through your account settings or the Stripe Customer Portal. Cancellation takes effect at the end of your current billing period; you retain access through that date.

We may change our pricing in the future. Any pricing change will not affect your current billing period. We will give existing Pro subscribers at least 30 days' notice before increasing recurring subscription prices.

Your first report on the Service is provided free as part of the new account onboarding experience. This offer is limited to one free report per person and is at our discretion to modify or discontinue.

5. REFUND POLICY

Our refund policy is straightforward and final:

Single Reports ($19): If a report fails to generate any meaningful results (for example, the ASIN you submitted produces an empty or error-state report due to insufficient review data, an inaccessible product page, or a technical failure on our end), email us at reports@openasin.com with the report ID. We will issue a full refund of the $19 charge AND credit your account with one additional free report so you can try a different ASIN.

Pro Plan Subscriptions ($47/month): All Pro Plan subscription fees are non-refundable. No exceptions. The Pro Plan provides unlimited reports at a flat monthly rate, which is a substantial discount over per-report pricing for any user generating more than two reports per month. Because subscribers have unlimited freedom to generate reports throughout the billing period, the occasional empty report or unusable result is not grounds for refund. If you are unhappy with the Service, you may cancel at any time, and you will not be charged in subsequent months.

Refund requests for single reports must be submitted within 30 days of the original charge.

6. ACCEPTABLE USE

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

Use the Service in any manner that could damage, disable, overburden, or impair our servers or networks.

Attempt to gain unauthorized access to other user accounts, our systems, or our data.

Use automated tools (such as bots, scrapers, or crawlers) to access the Service in ways not authorized by us.

Resell, redistribute, or republish OpenASIN-generated reports as your own work or as a competing service.

Use the Service to engage in activity that violates Amazon.com's Terms of Service or Conditions of Use.

Use the Service for any illegal purpose or to facilitate illegal activity.

Submit fraudulent, malicious, or abusive content through the Service.

Pro Plan subscriptions include unlimited report generation under normal individual or business use. While there are no hard limits, we reserve the right to investigate and limit accounts that exhibit clearly automated or abusive behavior such as generating thousands of reports per day through automated scripts, reselling or redistributing reports as a competing service, or sharing account access with parties outside the original subscriber's organization. Normal heavy usage by professional sellers, agencies, and research teams is encouraged and supported.

We reserve the right to investigate and terminate accounts that violate these provisions.

7. INTELLECTUAL PROPERTY

The Service, including its software, design, content (excluding user-submitted data and Amazon review data), and the OpenASIN brand and marks, is owned by Anna Bauman, doing business as OpenASIN, and is protected by U.S. and international copyright and trademark law.

Reports generated by the Service are provided to you for your own internal business use. You may share reports with members of your own team or organization. You may not republish reports publicly, sell them as your own product, or use them to operate a competing service.

Amazon and Amazon-related trademarks are the property of Amazon.com, Inc. Customer review content visible on Amazon belongs to its respective authors and to Amazon under their terms of use. We do not claim ownership of review content. We provide analysis and insight on that publicly available content.

8. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that:

The Service will be uninterrupted, error-free, or available at all times.

The reports generated will be accurate, complete, or suitable for any particular business decision.

Any specific outcome, financial result, or product improvement will result from using the Service.

The Service is intended as a decision-support tool. You are solely responsible for any business decisions you make based on the information provided. Reports are based on AI analysis of customer reviews, which may contain inaccuracies, biases, or out-of-date information. Always exercise your own judgment.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law, in no event shall Anna Bauman, OpenASIN, or any of our affiliates, employees, contractors, agents, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses, arising from or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) the total amount you have paid us in the 12 months preceding the claim, or (b) $100 USD.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Anna Bauman, OpenASIN, and our affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of any rights of another party, or your violation of any applicable law.

11. TERMINATION

You may terminate your account at any time by emailing reports@openasin.com. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service immediately ceases. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, indemnification, and limitation of liability) shall survive.

12. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Allegheny County, Pennsylvania, and you consent to the personal jurisdiction of those courts.

13. CHANGES TO THESE TERMS

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top. Significant changes will be communicated to active users by email at least 14 days before they take effect. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.

14. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OpenASIN regarding the Service and supersede any prior agreements or understandings, written or oral, regarding the Service.
